1. Introduction

Capital Monitor - capmon.com as it is commonly known - is a special news service from LexisNexis that is focused primarily on Australian Commonwealth government policy information and its development, but it covers State and Territory Parliaments, Governments, agencies, and the Courts, as well.

If you work in an environment that is heavily regulated by Government, the Capital Monitor service will saves you time to concentrate on your real tasks of working to have policy changed, anticipating policy changes, interpreting policy changes, responding to policy changes or handling issues. You no longer need to spend time gathering the public information or, worse, having your work negated by unidentified policy changes.

A typical Capital Monitor service supplies information about developments in one or more policy areas to you, as an individual recipient, but it can be expanded to supply to multiple addressees. It is normally delivered via e-mail, but RSS feeds, organisation-wide Intranets and automated systems are also available.

As soon as the material has been forwarded to subscribers, it is indexed on the Capital Monitor website where it becomes part of an electronic reference library, accessible to you as a subscriber. The website also provides a range of other automated facilities to support subscribers.

Subscribers can also call on our staff, either to assist them in their use of the website facilities or to undertake research.

This document details the range of products and services provided by LexisNexis through Capital Monitor for a typical individual subscriber. Other groups or national organisation-wide arrangements are also outlined but we recommend that new users gain experience with an individual subscription before developing more complex delivery and support arrangements.

2. Outline of the Service

What You Get and How Much You Pay

A subscription to the Capital Monitor service provides:

The material provided is the original statement, regulation, Bill, report, etc, in PDF format, normally attached to the alerting e-mails.

What you are buying when you subscribe is time. For information on our charges for all of our services click here.

The cost of more complex Capital Monitor services, eg to multiple users and/or via Intranets, is available on request but, as stated, we recommend that new users start by gaining experience with a single-user service. You really have to experience this service to appreciate how it can be used assist your organisation.

Services Agreement

Subscribers who subscribe to a Capital Monitor service are obliged to accept the terms and conditions in the Services Agreement as part of their subscription. A copy of the Service Agreement can be found here.

The Services Agreement requires that subscribers, amongst other things, agree that they:


Subscribers can, of course use the contents, ie the implications, of the information we supply immediately in their own material, for example as the basis of the subscriber's opinions, comment, advice or instructions. They are just not permitted to distribute the actual documents on the same working day.

If you have any queries about any aspect of this Agreement, or wish to vary the Agreement to suit your particular requirements, we will be happy to discuss these matters with you. For example, if subscribers work as part of a geographically dispersed but integrated functional unit, their Capital Monitor service(s) may need to operate under a variation of the standard Services Agreement.

Delivery of Material

Within minutes, our staff will deliver a copy of the announcement - press release, regulation, bill, report, gazette notice, etc. Delivery will be via e-mail, RSS feed or an Intranet page, as determined by you. You decide whether to read, keep, print, etc the material itself, which will have been either attached to the e-mail or, if a very large file, hyperlinked for immediate downloading.

Telephone Alerts

If something happens (or is about to happen) that is about your organisation, we will call you immediately.  These calls are part of our service.

Website Access

In addition to receiving your news by e-mail or RSS as it happens, you will be given your own User ID and password to allow you to access the Capital Monitor website to conduct research, check developments or use the automated support tools. You can use these facilities at any time or from anywhere.

Hours of operation

The website is available to you 24 hours, 7 days a week. You can e-mail help@capmon.com or call our office on 02 6273 4899, for further assistance.

Our normal office hours are 08.00-18.00 AEST Monday to Friday and 10.00-14.00 on Sundays but, if you call our office outside those hours, our duty News Manager will assist you.

We will discuss the kind of subjects you need, and develop your initial monitoring brief from that. If your information needs change, just let us know.

Changes to your brief

Public policy issues are dynamic, your organisation's functions and structures may change, and we want to ensure you stay ahead of any developments that are important to you. Through the Capital Monitor service, we will let you know about emerging issues, or matters about to happen, which could be important for you. You will need to let us know about changes in focus at your end.

Generally, you will need to contact help@capmon.com if you want us to modify your primary monitoring brief.

You can also use our online systems (Digests and What's New Topics) to monitor the States or the Courts, or keep an eye on additional subjects.  These automated tools give you flexibility in what you want monitored by our website system, and how and when you are alerted by those automated systems, but they are quite separate from your primary news service, which is operated by LexisNexis staff.

3. Content & Coverage

The following section details what Capital Monitor service will monitor for you, and what is available to you in each of our historical collections.

Commonwealth policy issues form the basis of our primary monitoring service that is delivered to you during the day.

The Capital Monitor service also keeps an eye on what happens in the States and the Territories, and in the Courts which, as explained, is generally provided to subscribers by self-selected automated means - What's New Topics, Digest e-mails, etc. Subscriber-selected automated delivery mechanisms are offered because not all subscribers are interested in State and lower court material all of the time, and some of this material may have taken several days to be made public.

Capital Monitor's services vary for each jurisdiction and these are outlined below.

Commonwealth Parliament & Government

LexisNexis employs professional staff in Parliament House, Canberra, watching what is said, released, tabled or published in the Parliament, the Government or the High Court, including their websites, for inclusion in the Capital Monitor service   This is our primary service to you: if anything is released and it affects the subjects we are monitoring for you, then we will send you a copy immediately.

The Capital Monitor service monitors all judgments, decisions or determinations of the:

We will deliver to you any High Court decision, if it is relevant to your brief, because it is 'policy'.  This is part of your Capital Monitor subscription.

Other court or tribunal decisions are on our website, and available through searching, or you can keep an eye on them using What's New Topics and their associated Digest e-mails. Quite often court decisions cause policy changes, so subscribers need to be aware of them.

The collections of most kinds of Commonwealth material date back to January 1990, with full-text indexed, downloadable material available from the Capital Monitor website from the start of the Howard Government in March 1996.

 

The States and Territories

For Quick Info (ACT, NT, NSW, Qld, SA, Tas, Vic, WA)

The Capital Monitor service provides you with a series of collections covering each of the States and the Territories (ACT & NT).In some instances, State policy developments interact with Commonwealth policy matters. On the other hand some subscribers need to follow closely State issues in particular States.

You can use automated facilities like What's New Topics or Digests to monitor any of the States for any subject matter, or mentions of any specific issue, company or person.  This will ensure that you are kept alert to anything that happens in those States.

The services covering each of the States and Territories vary slightly and are being developed continuously.  Some have been in existence for many years, and have more historical material in their collections.  This can be established by a quick search, displaying results in ascending date order (remembering to tick all the archive years), however the following information is provided as a guide:

Australian Capital Territory

The Capital Monitor service collects and files all press statements issued by members of the ACT Legislative Assembly, as well as Gazettes, Bills, Acts, Regulations, ACT Supreme Court Judgments and other related material.

We e-mail any generally-significant ACT policy material as part of our normal Capital Monitor service because ACT and Commonwealth policy developments are often intertwined.

The ACT material dates back to January 1990.

A separate database collections for ACT Hansard, Bills, Supreme Court collections and an ACT Main collection of press releases, gazette items, Orders, Determinations, press releases, etc is available, together with an associated separate collection if you want to search just ACT Gazette material.   These separate collections were commenced in late 1997.  Earlier ACT material is filed in our Federal Main collection and in Archives.

Northern Territory

This is the 'youngest' collection.  It contains press releases collected since Dec 2001, Bills since Dec 2001, Hansards since Jan 2003, and NT Supreme Court decisions since early 2001 & NT Gazette since 2007.

NSW

In addition to a comprehensive weekly newsletter, the Capital Monitor service provides a number of services for any organisation which is interested in the happenings of the New South Wales Government. Monitoring of New South Wales material commenced in December 1996. Since then, the collection has considerably expanded to include:

Queensland

All statements issued by Qld Ministers are collected and filed immediately they are released. A range of other Qld news and information is also collected.

South Australia

All press statements by the South Australian Government are collected and filed, together with SA Supreme Court Judgments, Hansard and Bills, as they are received. The start dates of the South Australian collections are as follows:

Tasmania

All press statements by the Tasmanian Government are collected and filed here, together with their Supreme Court Judgments, as they are received.  The start dates of Tasmanian collections are:

Victoria

Capital Monitor has offices in the Parliamentary Press Gallery in Melbourne and provides detailed services covering the Victorian Parliament and Government: The start dates of the Victorian material is as follows:

Western Australia

This collection was started in late 1997.  All press statements by the West Australian Government are collected and filed here, together with their parliamentary material, as they are received. The dates of the WA collections are as follows:

4. Website Browser Pages and Automated Delivery Systems

In addition to delivering Commonwealth policy information on a real-time basis, and providing search facilities with our electronic library, we also provide a series of pages and other facilities on the Capital Monitor website so you can browse through much of the material you may need some time after it has been initially forwarded to you.

The automated facilities also assist you to follow State and court developments and they supplement the "search" facilities.

What's New pages and Topics

What's New pages are automated browser pages on the Capital Monitor website. They are automatically updated as material is loaded onto our system after being delivered to subscribers. Each "What's New" Topic page lists the latest news and information on that particular Topic, eg Environment, Superannuation, Venture Capital, etc.

A key feature of most of the What's New pages and their associated Topics is that they display not just the Commonwealth material which is e-mails to subscribers. They also watch information on our State and lower courts collections. The timeliness of original publication of that material by the States can be variable, and its applicability may be limited, hence it is not e-mailed. The automated facilities, however, permit you to keep abreast of policy developments across many jurisdictions.

There are over 200 pre-set Topics to select from. You select which of the associated What's New pages you want to be displayed when you access the Capital Monitor website. If you think there is a subject of general interest for which we have not yet created a pre-set Topic, please advise us.

When you logon, you can look at your own personal pages simply by clicking on What's New. Having access to these What's New pages means that you can keep an eye on developments if you are travelling or if your e-mail/RSS systems are down. The only proviso is that Hansard material, which we is e-mail as part of your subscription, cannot normally be covered by automated Topics. (Due to its page layout, Hansard material can generate too many duplicate results.)

You can choose to have any Topic immediately send you a simple alert (E-mail Advisory), or the document (E-mail Document). Your What’s New page also gives you the option to create a Personal Topic (probably for competitive intelligence purposes). Typically, subscribers use these automated delivery options for very short-term monitoring, when they are expecting a development of interest in a subject area that they do not normally monitor. These forms of delivery are additional to your main subscription.

You therefore have three options for automated delivery directly by Topics:

  1. What's New Web Page Only (no charge) - most subscribers have lots of those.
  2. E-mail Advisory (charges apply)
  3. E-mail Document (charges apply)
or you can subscribe, via the Digest page, to receive the associated weekly or daily Digest e-mail (see below) - these are quite popular, too.

Digests

Digests are automated daily or weekly e-mails that are associated with each What's New Topic. They list summaries, with hyperlinks, of everything relevant to that Topic from the previous day or week. Subscribers use the Digest browser page to select which Digests they would like delivered. As indicated, there are currently over 200 available Digests, one for each pre-set topic. A "standard" subscriber can have up to five Digests running in any month at no additional cost.

The significance of Digests is that, like their associated Topics, most cover lower courts, tribunals and State/Territory material, as well as the Commonwealth. Thus a Superannuation Daily Digest e-mail provides a way to watch any relevant Federal Court or Administrative Appeals Tribunal decisions that may have been handed down during the previous day.

Some subscribers use Digests just to give them better in-depth coverage of their normal interests; others use them to keep an eye on peripheral issues where they may not want to be bothered by an e-mail during the day. For example, a subscriber receiving an Aged Care/Nursing Homes e-mail service during the day might also want to receive both a Daily Digest covering their primary interest of Aged Care (for its court and State content), and a Daily Digest covering general Health issues, both of which will be e-mailed on the following morning.

Like What's New Pages and Topics, Digest e-mails are automated and are intended just to back-up the primary, real-time e-mail or RSS service that delivers Commonwealth material to you during the day.

Personal Topics and Personal Digests

For an additional charge you can easily and simply create your own Topics, called Personal Topics, using the facilities on our website. You can even use this tool to create your own Personal Digests.

These features allow you to further personalise your news and information gathering on our systems or conduct competitive intelligence. You still retain your flexibility in selecting how and when you want to be alerted - e-mail Advisory or e-mail Document or Daily or even Weekly Digest e-mail delivery.

Bills Monitor

These browser pages display all Bills currently before the Commonwealth, NSW, VIC and QLD Parliaments.  These browser pages are maintained by Capital Monitor staff.

Bills Monitor browser pages give you a brief overview - the subject of the Bill and what stage the Bill has reached - with quick access to the Bill, its Second Reading Speech, Explanatory Memorandum and the Act, when it is finally passed.  Notes are also provided if the Bill is amended, negatived (defeated) or withdrawn, with details of when that happened.

Soon after the Bill receives Royal Assent, the reference is migrated across to the associated Acts Assented page (see next).

Acts Assented

These browser pages will give you the same details and links for Commonwealth and State Acts, year-by-year, going back to 1998 in the case of the Commonwealth Bills Monitor.

Proclamations

This page lists all Proclamations under Commonwealth legislation (in chronological order) made this year, with links to other pages listing all Proclamations since 1997.

Tax Rulings

This page lists all the current and previous years' Tax Rulings and Determinations, going back to 2000, grouped under their various types, for simple and fast retrieval.  The listings also mention amendments, withdrawals, etc.  The page has an internal search function.

High Court

This page lists all this year's High Court judgments and amendments, with quick links.  The page also has an internal search facility, and links taking you back through all decisions of the High Court since 1998.

Federal Budget

Capital Monitor staff attend each Budget lockup and comb through all the information.

We publish the Budget browser pages, typically before the Treasurer has finished his Budget Speech, and we e-mail to subscribers anything that affects them shortly after the Treasurer starts delivering the Budget Speech.

The Budget browser pages allow subscribers, particularly those working on the night, to get fast access to all Budget information including a synopsis of the Budget announcements, the Budget Speech, all the Budget Papers, and a portfolio-by-portfolio listing of all Ministerial statements.  The site has the same details for all Federal Budgets since 1997.

Federal Election

These browser pages give you quick access to a range of information including all policy promises made, party-by-party, portfolio-by-portfolio, as well as election results and other Federal Election information.  Election material is displayed for each Federal Election since 1998.

Parliamentary Directory

Subscribers can opt to include a subscription to Capital Monitor's Parliamentary Directory.  This provides them with a loose-leaf hardcopy version that is updated bimonthly, and access to a special browser area on Capital Monitor's website.

Newsletters

The website displays the latest editions of both Capital Monitor’s Canberra Newsletter and our weekly NSW Newsletter.  For more information on these Newsletters and the CM Password Victorian Newsletter, click here.

Calendar/Diary

You can quickly see what is happening, or going to happen, around Australia: when any State or Territory Parliament is sitting, special events, scheduled announcements, etc, so that you can be prepared or plan your own events.  Subscribers who need to be in the know can have the Diary delivered to them by e-mail. Publications

This lists all recent hardcopy publications released by the Federal Government through Canprint, and provides the facility for you to search all publications issued since 1996.  You can even use the online form to order any publication to be purchased and delivered to your desktop the following day.

Special Information Pages

When the Federal Government makes major announcements, we will create special information pages for that event (eg, the 1998 GST/Tax Reform Policy announcements, the 1999 Ralph Report on the Review of Business Taxation, etc).

We advise subscribers of these events before they occur, and set up the pages in advance so people can bookmark them for faster access on the day, if they cannot wait until their e-mailed material arrives.

Links

The Links browser page provides quick access to a number of other websites that are commonly used by subscribers.  You can quickly access the Federal Parliament’s daily agenda (The Senate Red or Reps Blue), their Daily Notice Papers, Journals, Votes and Proceedings, scheduled sitting dates, as well as links to the websites for each of the State and Territory Parliaments.

There are also links to older special information pages (eg, the Ralph Report), plus the Federal Government's Online Directory, popular web search engines, the White Pages and Yellow Pages, as well as other information.  Again, these are provided to allow you to quickly and simply access what you might need at any time.

5. Other Services

Newsletters

The Canberra Newsletter, is provided to all news subscribers as part of their subscription.
A NSW Newsletter, is available on subscription, as well as a newsletter covering the Victorian Parliament, the Parliamentary Monitor (Victoria), (also available on subscription)

All previous copies of these newsletters are indexed and filed for later search and retrieval on our website.

Canberra Newsletter

At the end of each Parliamentary sitting week, a weekly Canberra Newsletter is published ,and a copy is sent to every subscriber free, as part of their subscription.  The weekly Canberra Newsletters are then consolidated into a monthly Canberra Newsletter.

The Canberra Newsletter provides a snapshot of every policy development, portfolio-by-portfolio, a listing of each Proclamation and Taxation Ruling made, details of forthcoming legislation, and an Editorial Comment, which puts some of the policy and politics into perspective.

The Canberra Newsletter aims to give you a quick reference to everything that has happened in Canberra during the period under review.  Each report is linked to the source document on our website, allowing you fast access to anything you might need.

It is published in HTML format, allowing quick reading and easy navigation for readers. 

NSW Newsletter

The NSW Newsletter is published each Monday.  It is available as an optional extra for subscribers who also need to watch the NSW Government and Parliament.

The NSW Newsletter lists major press statements made during the previous week, all reports presented, each new regulation made, and then lists all Assents, Proclamations, Orders, Rules, etc and new Bills presented to the Parliament.  The NSW Newsletter also contains our NSW Bills Monitor.

Again, each listing is linked to the source document.  It also is published in HTML.

The NSW Newsletter is $44 per month

Victorian Newsletter

Our Melbourne office is located in the Victorian Parliament's Press Gallery and, in addition to providing real-time monitoring, publishes the Parliamentary Monitor (Victoria) each Friday. A copy is sent to all our subscribers who elect to subscribe to this service.

This newsletter covers everything that has happened the Victorian Parliament and Government during that week.  It reports on each new Bill presented, all debates, questions, statements and papers tabled in each House, all new regulations, reports, and inquiries.  It also lists each of the press statements made by the Government, Opposition and others.

The Victorian Parliamentary Monitor is $66 per month

Parliamentary Directory

The Parliamentary Directory, is published in a loose-leaf folder for your office bookshelf with updates posted every two months Subscribers who take up this option also get access to continually updated information in a special area on our website. That part of the website also contains our CVs of all Federal Parliamentarians.

The Parliamentary Directory lists details of all Members, Senators, party composition, the Ministry, Shadow Ministry and the Democrats' portfolio responsibilities and staff.  It also provides all details on every Committee - Cabinet, Caucus, Opposition and Parliamentary, as well as the latest listing of all members of the Federal Parliamentary Press Gallery.  Also included are the latest lists from each of the State Parliaments, the ACT and the Northern Territory. Thus you have all the information you need, in all Parliaments in Australia, in one handy resource.

The 2005 subscription for the Parliamentary Directory is $200.

POLADD

To make it easier for you to correspond with Federal Members and Senators, we can supply by e-mail a small database file that contains full address and contact details of all Federal parliamentarians. This enables you to use word-processing, fax and e-mail to create personal letters, address labels, etc.

The files allow users to perform any number of filters and sorts, eg, addressing only Federal Coalition backbenchers, who hold their seats with less than a 3% margin, within certain postcodes.

A special edition of POLADD is prepared during Australian Federal General Elections, containing similar details for all election candidates. These can also be sorted and selected according to any of the criteria you may want to use.

Press Releases

We can quickly print, copy and circulate your press releases in the Press Gallery in the Federal Parliament in Canberra.  In that way, in addition to the major media, the Prime Minister, Opposition, Democrats and the Parliamentary Library also receive the material directly.

We can photocopy your press statement from a fax or e-mail (news@capmon.com) on to plain paper or, if you want to make a better impression, you can provide us, in advance, with some of your letterhead. (We keep it safely).

Alternatively, if time permits, you could forward 125 copies of your press statement with instructions about the timing of distribution.  Don't forget, if you want the media to use the statement, they will want the copy immediately after it has been released - two days late is days too late!.

Subscribers also e-mail to news@capmon.com their own press releases, studies, etc, for use by our News Managers. If considered to be of policy significance in the current environment, they may be distributed to other subscribers, as part of our news services. There is no charge for this but we reserve the right to decide whether the press statement warrants e-mailing as a policy matter.

Press Conferences

Our staff attends all major press conferences and lockups.  In general, we will make prior arrangements with you to supply relevant information quickly.  If you know of a press conference that you want us to attend or monitor, please let us know.

Media Monitoring

We can arrange ad hoc media monitoring for you, using Media Monitors, or Rehame.  This can be useful if you wish to preserve anonymity. You pay their price; we neither charge nor receive a commission.

Research

If you need information beyond what is on our website, call us.  In many cases we can provide the answers immediately, which is part of the service. If the research looks like requiring significant resources, we will let you know and provide an estimate.

We has access to a vast range of material reaching back to 1900, so that we can provide information about new and historical political decisions and personalities, debates, gazettes, statutory rules, and more.  The resources available are quite extensive.

Archives and Document retrieval

We keeps a paper copy of all Canberra press releases, Hansards, transcripts, Gazettes, Bills, 2R Speeches, EMs, Reports, etc.  These files go back to 1 January 1990.

We keep about 12 months material to hand - the rest is stored in our secure archives off-site in Canberra.  We are able to retrieve these files quickly and supply you with a copy whenever needed, for example for court cases.

6. Intranet Services

Capital Monitor are able to provide the Capital Monitor service and information pages as an Intranet (or integrated as part of existing Intranets) in your organisation.

This provides wide access to our news and information services across your organisation, allowing your staff to be kept informed of what is important to them.

We are able to build and maintain the Intranet service, so there are no IT outlays from your end. The service relies on a fixed IP Address, and can be badged with your logo and use your organisation's colours and styles.

In addition to displaying the Capital Monitor search pages, your Intranet pages can display any of the What's New Topics, plus any specific issue or competitive intelligence topics that your firm or organisation may want to cover, and which your Intranet Administrator creates. You can also display any of the Capital Monitor standard browser pages (eg Bills Monitor, Tax Rulings, High Court). This is just a matter of choosing what is best suited for your own purposes.

The Intranet service can also provide all your staff with access to all our historical archives and search facilities.

The service appears in your corporate style - logo, colour, etc - and can sit seamlessly within your own corporate Intranet. Your Intranet can be set up and deployed across all desktops within your organisation very quickly - the main delays tend to be the subscribers deciding on matters of style, and choosing what is to be displayed.

Intranet Features

The Capital Monitor Intranet service puts the Capital Monitor website service on the desktops of everyone in your organisation. While the benefits of providing the search facilities are obvious, having Intranet access also allows your staff to refer in their work, eg internal News Alerts and opinions, to Capital Monitor material by hyperlinks. Those hyperlinks allow access to the documents to anyone in your organisation, without having to distribute the PDF files across your IT systems.

There are no charges for downloads through Intranets.

We can even host your own data and make it available through your Intranet.  This includes being able to make files searchable, using our search engine, and providing the facility for you to upload any new data.

Intranet Fees

The Capital Monitor Intranet services are charged at a flat-fee: no download charges, no extras or hidden costs. The service is simple to budget for and to administer.

The subscription is based on the number of people using your Intranet, and the number of librarians or others requiring special, ie individual, access or support (like receiving e-mail news services). The per capita costs for most organisations are less than the cost of a daily newspaper.

7. Fees and Charges

Capital Monitor will provide you with a firm quote for any of our services.  We will work with you to make sure you get the service you need to fit within your budget, and to make sure that you can plan confidently with this budget.  There will be no surprises.

The following information is provided as a guide.  Please contact us to get a quote on the service you need.

Subscription

Capital Monitor prices its services based on the number of topics (or subjects) that the subscriber wants covered, and the level of service required, ie the discernment required to satisfy your information requirements.

Please call us on 02 6273 4899 to discuss your brief or mention your interest to your LexisNexis Account Manager.  Typically many issues overlap and Capital Monitor treats them as the one issue.  Your LexisNexis Account Manager will be pleased to discuss these with you, and provide a firm quote.

We strongly recommend you undertake a three-month trial of the Capital Monitor service.  After this, you can elect to receive a 10% discount for paying your subscription annually in advance, commencing at a time to suit your budget arrangements.

Please note that LexisNexis expects prompt payment of accounts for Capital Monitor Services. Our terms are 30 days for payment and overdue payments may be subject to an administrative charge.

Intranet Services

Capital Monitor are able to provide the Capital Monitor service and information pages as an Intranet (or integrated as part of existing Intranets) in your organisation.

There is an establishment fee to cover the cost of the IT work to set up the Intranet pages to meet your operational requirements and integrate them with your organisation's existing Intranet. We can discuss these with you prior to commencement of any work.

Once established, your Intranet service is charged at a flat-fee - there are no extra charges, hidden costs or surprises when operating it. A minimum 12-month contract is required and it is invoiced monthly in arrears or annually in advance, by negotiation.

The service requires a fixed IP Address (or range) to be supplied by the client organisation, plus certification of the number of users in your organisation.

Capital Monitor does the best it can to get you the news and information you need as quickly as possible. Nevertheless, we still need to take precautions, and users or subscribers need to be aware of these.

LexisNexis, Capital Monitor and its associated companies not liable to any subscribers or users for any loss or damage (including consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly in respect of the news or information supplied.

Copyright Matters

LexisNexis and Capital Monitor does not accept any responsibility for the changes relating to the availability, contents or conditions in relation to the usage of the Copyright Materials which may be imposed by a third party from time to time.

As a news service holding appropriate copyright licences, Capital Monitor can distribute its material to you. You need to seek appropriate authorisation if you wish to republish it.

No Responsibility for Telecommunications Links

LexisNexis and Capital Monitor does not accept responsibility for the breakdown or malfunction in any manner whatsoever of any of the telecommunications links upon or through which the Subscriber gains access to the Information.

Upgrades or Modifications to Our Systems

Users of Capital Monitor's services need to acknowledge that we have to be able to regularly update, upgrade or modify our software and systems; and you might not be able to access the news and information services on our website during these times. Capital Monitor always endeavours to undertake such activities outside of normal business hours in the shortest possible time and will notify subscribers of any planned downtimes in advance. Nevertheless, LexisNexis and Capital Monitor cannot be responsible for unforeseen downtimes.

9. Privacy Policy

When you browse Capital Monitor's website, our system automatically records your visit and logs the following information that is maintained for statistical analysis: your IP address, the date and time of your browsing, the pages you read, the type of browser you use, and which documents you downloaded.  Capital Monitor's website is cookie-free.  We do not record your identity or any other information.

The data our systems collate is compiled with other logs of activity on our website that is statistically analysed, and compiled into an overall management report, without reference to any specific identities.

If you are a visitor to our website, and not a subscriber, we do not record your identity or e-mail address, unless you choose to send us a message, or apply for a service.  Your e-mail address will then be used only for that purpose.

If you are a subscriber, your User ID is recorded against those records of any documents downloaded from billable collections.  This is used only for billing purposes and statistical reporting of the patterns of downloads made in any calendar month by all subscribers, or to alert our management to possible abuse of your own User ID/password.

Any e-mail addresses provided to Capital Monitor will only be used for the purposes they were provided.  Capital Monitor and LexisNexis will not disclose your e-mail address to others without your prior approval.

Similarly, Capital Monitor and LexisNexis will not disclose the names of our subscribers or their interests to any person without the prior consent of the subscriber.
